Colorado HOAs are governed primarily by the Colorado Common Interest Ownership Act (CCIOA), codified at C.R.S. § 38-33.3. Unlike many states, Colorado has an active legislative environment around HOA governance — and 2024 and 2025 brought some of the most significant changes in the law’s history.

CCIOAC.R.S. § 38-33.3

The primary governing statute for all Colorado HOAs formed after 1992. Covers governance, assessments, record-keeping, open meetings, and owner rights.

Policy Disclosures§ 38-33.3-209.4

Associations must make governing documents, insurance policies, meeting minutes, and nine required governance policies available to unit owners.

Open Meetings & Records§§ 38-33.3-308, -317

Most HOA board business must be conducted in open meetings. Records must be accessible to owners — a compliant website is the most efficient way to fulfill this continuously.

HB25-1043(Effective Oct. 1, 2025)

HOAs must now strictly comply — not just substantially comply — with CCIOA’s assessment and foreclosure requirements. Non-compliance can result in courts staying foreclosure proceedings entirely.

HB24-1337(2024)

Caps recoverable attorney fees in HOA foreclosure actions and prohibits foreclosure while an owner is complying with a payment plan. Requires delinquency notices in the owner’s preferred language.

HB25-1272 — Colorado American Dream Act(August 2025)

At least 65% of all unit owners must now vote to approve before an HOA can file a construction defect lawsuit against a developer — up from a simple majority.
